A Preliminary Notice must be given to the general (primary) contractor or owner prior to commencement of work or supplying materials on a construction project or they must be given within the time limitation set forth by each state’s statutes. If Preliminary Notices are not timely given, you may lose your right to claim a Mechanic’s Lien against the project. As a contractor, material supplier, or subcontractor providing services on a residential or commercial project, you are entitled to record a Mechanic’s Lien to secure your right to collect against any residential or commercial property upon which you provided labor or material and have not received payment. You must record your Mechanic’s Lien within the time limitations set forth by each state’s statutes or you will lose your right to record a lien.

Any Mechanic's Lien not timely recorded may be considered a wrongful lien, which may result in detrimental consequences to you.
